1. About Seven Medical Supply

Seven Medical Supply reviews offers from individuals who wish to sell eligible unused diabetic supplies and may purchase qualifying products for resale through appropriate wholesale channels. We are not a healthcare provider, pharmacy, insurer, or medical-advice service. Nothing on the site is medical, legal, tax, or financial advice.

2. Eligibility and Capacity

You must be at least 18 years old and legally capable of entering a binding agreement to use our quote and purchasing services. If you act for another person or organization, you represent that you have authority to bind that person or organization.

3. Quote Requests

A quote request is an invitation for Seven Medical Supply to review information about products you may wish to sell. Submitting a form does not require us to make an offer, accept any product, or complete a transaction. You must provide complete and accurate information and photos and promptly correct material errors.

4. Seller Representations and Warranties

By submitting or selling products, you represent and warrant that:

• You own the products or otherwise have full legal authority to sell and transfer them.
• The information and photos you provide are accurate, complete, current, and depict the products proposed for sale.
• The products are authentic and were lawfully obtained.
• The products are not stolen, counterfeit, fraudulently obtained, improperly acquired, subject to another person’s ownership or security interest, or otherwise unlawful to possess, sell, or transfer.
• The transaction does not violate applicable law, contract, program restriction, or third-party right.
• You have disclosed material facts about condition, packaging, expiration, identifiers, storage, and product history.

These representations continue through final acceptance and payment.

5. Government-Funded Products

You may not submit or sell products that were paid for, supplied, or reimbursed by Medicare, Medicaid, the U.S. Department of Veterans Affairs, TRICARE, or another government-funded benefit program where resale is prohibited or otherwise unlawful. You are responsible for determining that you have the lawful right to sell each product.

6. Product Eligibility

Products must meet our current purchasing requirements. Used, opened, unsealed, tampered, contaminated, altered, counterfeit, expired, stolen, fraudulent, unsafe, or otherwise unlawful products are not eligible. Materially damaged packaging or products may be ineligible, but ordinary exterior wear or packaging condition may be evaluated individually.

Eligibility can also depend on product type, authenticity, expiration and remaining shelf life, identifiers, packaging, condition, storage, marketability, current demand, and other business or legal considerations. International packaging, NDC, UPC, and similar identifier requirements are reviewed individually. We may decline recalled, temperature-sensitive, prescription-restricted, or other products that we cannot lawfully or safely purchase or resell.

7. Preliminary Quotes and Purchase Offers

Any quote based on submitted information or photos is preliminary, nonbinding, and subject to physical receipt, inspection, verification, and final acceptance. A preliminary quote is not a guarantee that a product will qualify or that a particular amount will be paid.

Our offers are independently determined business offers. They are not appraisals or representations of retail price, replacement value, resale value, or fair-market value. You are free to accept or decline an offer before shipping.

8. Differences After Inspection

If products received differ from the description or photos, or if inspection identifies an issue involving quantity, identity, condition, packaging, expiration, authenticity, legal eligibility, marketability, or current demand, we may revise or withdraw a preliminary quote, reject some or all products, request more information, or propose a final accepted amount. No revised transaction is complete until final acceptance.

9. Shipping Instructions

Do not ship products until Seven Medical Supply provides confirmed shipping instructions. You must follow those instructions and package products carefully and appropriately. You are responsible for providing accurate shipment information and avoiding the inclusion of products or personal materials that were not approved for review.

10. Shipping and Carrier Risk

Seven Medical Supply is not responsible for carrier delay, misdelivery, theft, loss, damage, or other events outside our reasonable control. Responsibility and available remedies may depend on the shipping method, who supplied the label, insurance, tracking, packaging, and whether our instructions were followed. Nothing in these Terms makes you automatically responsible for every shipping loss regardless of the circumstances.

You should keep shipment and tracking records. Delivery confirmation only shows carrier delivery; it does not establish inspection, eligibility, acceptance, title transfer, or payment.

11. Inspection and Verification

After physical receipt, we may inspect and verify product identity, quantity, packaging, seals, expiration, condition, authenticity, storage indicators, identifiers, legal eligibility, marketability, and consistency with the information and photos submitted. We may use reasonable anti-fraud and authentication procedures and request additional documentation.

12. Final Acceptance and Transfer of Title

Receipt or delivery alone is not acceptance. Title to products accepted for purchase transfers to Seven Medical Supply only after physical receipt, inspection, verification, and final acceptance. Until then, no purchase is complete. After final acceptance, payment may be initiated according to our payment process.

13. Payment

Payment is issued only after received items have been inspected and verified and the final amount has been confirmed. Available payment options and applicable timing will be communicated before the transaction is completed. We do not guarantee a particular payment method or fixed payment timeframe.

We may withhold, delay, cancel, or recover payment when reasonably necessary to investigate suspected fraud, error, duplicate payment, unlawful activity, chargeback, ownership dispute, or a material breach of these Terms, subject to applicable law.

14. Taxes and Documentation

You are responsible for your own tax obligations. Seven Medical Supply may request a W-9, taxpayer identification information, or other documentation when reasonably necessary for tax reporting or legal compliance. These Terms do not state whether any particular transaction is taxable or reportable.

15. Nonqualifying Products and Returns

If an item does not qualify after physical verification, we will notify you. You may request return of a nonqualifying product, and you are responsible for return shipping and handling. Products will not ordinarily be disposed of without your authorization.

We may retain, refuse to return, report, surrender, or otherwise handle a product as reasonably necessary when required by law or when we have a reasonable good-faith suspicion that it is stolen, counterfeit, fraudulent, unsafe, or otherwise unlawful to possess or return. Any such action may involve law enforcement, a government agency, manufacturer, carrier, or other appropriate party.

16. Prohibited Submissions

Do not submit or ship controlled substances, prescription drugs, needles or sharps that are used or exposed, biohazardous material, illegal products, products you do not lawfully own or control, or anything that creates an unreasonable safety risk. Do not upload faces, medical or prescription labels containing personal information, identification, insurance information, payment information, or other sensitive personal information.

17. Fraud Prevention and Right to Refuse

We may verify identity, ownership, product authenticity, transaction details, and compliance with law; limit or refuse quote requests or transactions; suspend communications; and preserve or disclose relevant information when reasonably necessary to prevent or investigate fraud, theft, counterfeiting, abuse, safety risks, or unlawful conduct. We may refuse a transaction for any lawful business reason.

18. Transactional Communications

By submitting contact information, you consent to transactional email, telephone calls, and text messages reasonably necessary to address your inquiry or administer a quote, shipping, inspection, verification, payment, return, or customer-support matter, where legally permitted. Message and data rates may apply. Consent to these transactional communications is not consent to promotional texts or other marketing communications that require separate consent.

20. Acceptable Website Use

You may use the site only for lawful personal or business purposes consistent with these Terms. You may not interfere with site operation or security; introduce malicious code; scrape, copy, reverse engineer, or access the site through unauthorized automated means; impersonate another person; submit false information; infringe rights; or use the site to facilitate unlawful, fraudulent, or abusive conduct.

21. Intellectual Property

The site, including its design, text, graphics, logos, images, and other content, is owned by or licensed to Seven Medical Supply and is protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to use the site for its intended purpose. No other rights are granted.

22. Third-Party Services and Links

The site or a transaction may involve third-party platforms, carriers, email services, payment providers, or links. Their services are governed by their own terms and practices. We are not responsible for third-party acts or omissions except to the extent required by applicable law.

23. Disclaimer of Warranties

To the maximum extent permitted by law, the site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, secure, or suitable for every purpose, or that every quote request will receive an offer or result in a completed transaction. Some jurisdictions do not allow certain warranty exclusions, so those exclusions apply only to the extent permitted.

24. Limitation of Liability

To the maximum extent permitted by law, Seven Medical Supply and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunity, or loss of data arising from the site, a quote request, shipment, or transaction.

To the maximum extent permitted by law, Seven Medical Supply’s aggregate direct liability arising from a particular transaction will not exceed the final accepted purchase value of the products involved in that transaction. This limitation does not exclude liability that cannot legally be limited or waived, including liability for fraud, willful misconduct, or other liability to the extent applicable law prohibits limitation.

25. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Seven Medical Supply and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your breach of these Terms; false or inaccurate information; lack of ownership or authority; submission of stolen, counterfeit, unlawful, unsafe, or improperly obtained products; violation of law; or infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct or other conduct for which indemnification cannot legally be required.

26. Informal Dispute Resolution

Before commencing a lawsuit or other formal proceeding, you and Seven Medical Supply agree to make a good-faith attempt to resolve the dispute informally. Please send a description of the issue, relevant transaction details, and the relief requested to support@sevenmedicalsupply.com. We will likewise attempt to provide notice and engage in good-faith discussion before initiating proceedings when reasonably practicable. This section does not prevent either party from seeking urgent injunctive relief or taking action necessary to preserve a claim or legal right.

27. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law or another jurisdiction’s non-waivable law applies. Subject to the informal dispute-resolution section above, any court proceeding arising from these Terms or a transaction must be brought in a state or federal court located in Santa Clara County, California, and each party consents to that court’s personal jurisdiction and venue. Nothing in this section waives a consumer right that cannot lawfully be waived.

28. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Changes apply prospectively unless applicable law requires otherwise. Terms applicable to a completed transaction remain subject to any non-waivable legal rights.

29. Miscellaneous

These Terms, together with the Privacy Policy and any written transaction-specific terms we provide, constitute the agreement concerning the site and applicable transaction. If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent; we may assign these Terms in connection with a merger, financing, reorganization, sale, or transfer of the business.
